This application — including but not limited to its source code, compiled JavaScript, CSS stylesheets, HTML structure, visual design, user interface layout, UX patterns, calibration system, scoring algorithms, spot management logic, folder system, and all associated concepts and ideas — is the exclusive intellectual property of the developer.

All content is protected under applicable copyright laws, including but not limited to the Berne Convention for the Protection of Literary and Artistic Works and relevant national copyright legislation.

      Unauthorized reproduction or distribution of any part of this application is strictly prohibited and may result in civil and/or criminal liability.

2. 🚫 Prohibited Actions

You expressly agree that you will not, under any circumstances:

Copy, reproduce, or duplicate any part of this application's source code, design, or functionality
Reverse-engineer, decompile, or disassemble any part of the application
Create derivative works, clones, or applications substantially similar in design, function, or concept
Distribute, sublicense, sell, rent, or otherwise transfer this application or any part of it
Remove, alter, or obscure any copyright notices, attribution text, or proprietary notices
Use the application's UI design, visual layout, or UX patterns as a basis for another product
Use the calibration system, scoring algorithms, or spot management concepts in competing products
Scrape, extract, or repurpose any part of the codebase for commercial or non-commercial projects without written permission
Represent this work as your own or claim authorship of any part of this application
Use automated tools to extract, copy, or replicate the application's structure or content

3. ✅ Permitted Use

You are permitted to:

Use this application for personal, non-commercial wind and wave forecasting purposes
Add your own spots, configure calibration settings, and export your personal data
Share the URL of this application with others
Install the application as a PWA on your personal device for offline use
Take screenshots for personal reference or non-commercial sharing

Any use beyond the above requires explicit written permission from the developer.

4. ⚠️ Forecast Disclaimer & Limitation of Liability

This application provides weather forecast data for informational purposes only. Yuval Zak makes no warranties, express or implied, regarding:

The accuracy, completeness, or reliability of any forecast data displayed
The fitness of this data for any particular purpose, including safety-critical activities
Uninterrupted or error-free operation of the application

      Model Data Only: All wind, gust, and wave values are numerical weather model outputs (ICON Global via Open-Meteo) — not real sensor measurements. Actual conditions at your exact location may differ significantly, especially near coastlines, hills, or sheltered bays.
    

You assume full responsibility for any decisions made based on data from this application. Yuval Zak shall not be liable for any injury, loss, damage, or harm — direct or indirect — resulting from use of or reliance on this application.

Always verify conditions through multiple sources and apply your own judgment before engaging in any water sports or activities where safety is a concern.

5. 🔐 Data & Privacy

This application stores all user data (spots, folders, calibration rules, preferences) locally in your browser using localStorage. No personal data is transmitted to or stored on Yuval Zak's servers.

The only external network requests made by this application are:

Weather forecast data from Open-Meteo.com (open-source, no account required)
Marine/wave data from Open-Meteo Marine API
Air quality data from Open-Meteo Air Quality API
Country detection on first visit via ipapi.co (IP-based, no personal data stored)
Map tiles from Esri / OpenStreetMap

      Your spot data never leaves your device. Exporting your data produces a local file for your own backup purposes only.

7. 📝 Changes to These Terms

Yuval Zak reserves the right to modify these Terms of Use at any time. Continued use of the application after any changes constitutes your acceptance of the revised terms. It is your responsibility to review these terms periodically.

8. ⚖️ Enforcement

Yuval Zak reserves the right to pursue all available legal remedies in the event of unauthorized use, copying, or distribution of this application or any of its components. This includes seeking injunctive relief, damages, and recovery of legal fees.

These terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these terms or use of the application shall be subject to the exclusive jurisdiction of the courts in the developer's jurisdiction.
